1. Preamble
In the following paragraphs we will show which data are processed when and for what purpose and on what legal basis. It is intended to explain how our services work and how the protection of your personal data is guaranteed.
All definitions refer to the basic data protection regulation (DSGVO).
According to Art. 4 No. 1 DSGVO, personal data is all information relating to an identified or identifiable natural person. A natural person who can be directly or indirectly identified is considered identifiable.
This data protection declaration can be accessed, saved and printed out at any time at https://nibsta.com/privacy.
Insofar as we cite our legitimate interest or a legitimate interest of a third party (Art. 6 para. 1 lit. f) DSGVO) as the basis for the lawfulness of the processing of personal data, you have a right of objection in accordance with Art. 21 DSGVO: In accordance with Art. 21 DSGVO you have the right to object to the processing of personal data at any time. We will then no longer process the personal data for the purposes of direct marketing or related profiling. Nor do we process your personal data for other purposes following an objection, unless we can prove compelling reasons for processing worthy of protection which outweigh your interests, rights and freedoms; or the processing serves to assert, exercise or defend legal claims (cf. for example Art. 21 Para. 1 DSGVO, so-called "limited right of objection"). In this case, you must give reasons for the objection that arise from your particular situation. You may also object to the processing of your personal data for reasons arising from your particular situation for scientific or historical research purposes or for statistical purposes pursuant to Art. 89 para. 1 FADP, unless the processing is necessary for the performance of a task carried out in the public interest (cf. Art. 21 para. 6 FADP).

5. Data security
Our website and other systems are secured by technical and organisational measures against loss, destruction, access, modification or distribution of your data by unauthorised persons. Despite regular controls, however, complete protection against all dangers is not possible.
6. General information
6.1 Log files
Every time you access our website, data and information is automatically collected by the system of your device and stored in so-called server log files. This data is information that relates to an identified or identifiable natural person (here: website visitor). The data is automatically transmitted by your respective browser when you call up our website. The following information is recorded:
The time at which our website is accessed (request to the server of the host provider),

the operating system you are using,

The purpose of this processing is to make our website accessible from your device and to enable our website to be displayed correctly on your device or in your browser. Furthermore, the data serves to optimise our website and to ensure the security of our systems. This data is not evaluated for marketing purposes. The legal basis for the processing is Art. 6 para. 1 lit. f) DSGVO. There is a legitimate interest in presenting you with a website optimised for your browser and in enabling communication between our server and your terminal device. The latter requires in particular the processing of your IP address.
The processed information is only stored for as long as necessary for the intended purpose or as required by law.
The recipient of the data is our server host, who works for us within the framework of an order data agreement.
The provision of the personal data is not required by law or contract and is also not necessary for the conclusion of a contract. You are also not obliged to provide the personal data. However, failure to provide it would mean that you would not be able to use our website, or would not be able to use it to its full extent.
6.2 Cookies
Our website uses cookies. Cookies are text files that are stored on your device to make using a website more convenient. Cookies can be used to save entries and settings on a website so that you do not have to enter them again each time you visit a new website. 6.3 Right of objection
The provision of personal data is not required by law or contract and is not necessary for the conclusion of a contract. You are also not obliged to provide the personal data. Failure to provide them may, however, mean that you may not be able to use our website, or may not be able to use it to its full extent.
Other services used by us also use cookies. We will inform you separately about the use of cookies for the individual services.
Transfers to third countries
If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this is done in the context of using the services of third parties or disclosure or transfer of data to third parties, this will only take place if it is done to fulfil our (pre-)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. 7. Information about Google services
On our website various services of Google Inc. ("Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. You will find more detailed information on the individual concrete services of Google that are used on this website in the further privacy policy. By integrating Google services, Google may collect information (including personal data) and process it. It cannot be excluded that Google may also transfer the information to a server in a third country. We cannot control what information Google actually collects and processes. However, Google states that, in principle, the following information (including personal data) may be processed among others:

8. Google Tag Manager
Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus integrate e.g. Google Analytics and other Google marketing services into our online offering). The Tag Manager itself (which implements the tags) does not process any personal user data. 9. Use of "Google Analytics
On our website we use Google Analytics, a web analysis service of Google Inc. ("Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the sites you visit. Google Analytics may also use so-called web beacons (non-visible graphics). These web beacons can be used to evaluate information such as visitor traffic on websites. The information generated by cookies and web beacons about the use of our website (including the IP address of the user) is transferred to a Google server, possibly in the USA or other third countries, and stored there. This information may be passed on by Google to contractual partners of Google.

Google Analytics is only used with activated IP anonymisation ("anonymous IP"). As a result, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there.
Furthermore, a contract for the use of Google Analytics has been concluded with Google for order processing (Art. 28 DSGVO). Google processes the data on our behalf in order to evaluate your use of the website, to compile reports on website activities for us and to provide us with further services related to website and Internet use. Google may transfer this information to third parties if this is legally required or if third parties process this data on behalf of Google.
By integrating Google Analytics, we pursue the purpose of analysing user behaviour on our website and being able to react to it. This enables us to continuously improve our offer.
The legal basis for the processing of personal data described here is Art. 6 Para. 1 lit. f) DSGVO. Our legitimate interest in this lies in the great benefit that the functions described above have for our offer. The statistical evaluation of user behaviour enables us in particular to react and optimise our offer in line with our interests.

10. Google Universal Analytics
We use Google Analytics in the design as "universal analytics". "Universal Analytics" refers to a Google Analytics method in which user analysis is based on a pseudonymous user ID, thus creating a pseudonymous profile of the user with information from the use of various devices (so-called "cross-device tracking").
11. Target group formation with Google Analytics
We use Google Analytics in order to display the advertisements placed within Google's advertising services and those of its partners only to those users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined by the websites visited) which we transmit to Google (so-called "remarketing" or "Google Analytics Audiences"). With the help of remarketing audiences, we also want to ensure that our ads match the potential interest of users.
12. Google Adsense with personalized ads
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").
Google is certified under the Privacy Shield Agreement and thus offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
We use the AdSense service to display ads on our website and receive compensation for their display or other use. For these purposes, usage data such as the click on an advertisement and the IP address of the user are processed, whereby the IP address is shortened by the last two digits. Therefore, the processing of user data is pseudonymous.
We use Adsense with personalized ads. Google draws conclusions about their interests based on the websites visited by users or the apps used and the user profiles thus created. Advertisers use this information to tailor their campaigns to these interests, which is beneficial to users and advertisers alike. For Google, ads are personalized when collected or known information determines or influences ad selection. This includes, but is not limited to, previous searches, activity, site visits, app usage, demographic and location information. Specifically, this includes: demographic targeting, interest category targeting, remarketing, as well as targeting of customer comparison lists and audience lists uploaded into DoubleClick Bid Manager or Campaign Manager.

13. Google Adsense with non-personalized ads

Google prohibits any personalized targeting, including demographic targeting and targeting based on user lists.

14. Google AdWords und Conversion-Messung
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").

We use the Google "AdWords" online marketing process to place ads on the Google advertising network (e.g., in search results, in videos, on web pages, etc.) to be displayed to users who have a presumed interest in the ads. This allows us to better target ads for and within our online services to show users only ads that potentially match their interests. For example, if a user is shown ads for products that he or she has shown an interest in on other websites, this is called "remarketing". For these purposes, when you visit our and other websites where the Google advertising network is active, Google executes code directly from Google and (re)marketing tags (invisible graphics or code, also known as "web beacons") are embedded in the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (comparable technologies can also be used instead of cookies). This file records which websites the user has visited, what content he or she is interested in and which offers the user has clicked on, as well as technical information on the browser and operating system, referring websites, visiting time and other information on the use of the online offer.
We also receive an individual "conversion cookie". The information obtained with the help of the cookie is used by Google to compile conversion statistics for us. However, we only learn the anonymous total number of users who clicked on our ad and were redirected to a page with a conversion tracking tag. We do not receive any information that personally identifies users.
User data is processed pseudonymously within the Google advertising network. This means that Google does not store and process, for example, the name or e-mail address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This means that from Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information collected about users is transmitted to Google and stored on Google's servers in the USA.

15. Google Doubleclick
On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").

We use the Google "Doubleclick" online marketing process to place ads on the Google advertising network (e.g., in search results, in videos, on web pages, etc.). Double Click is distinguished by the fact that ads are displayed in real time based on presumed interests of users. This allows us to display ads for and within our online offering in a more targeted manner, so that we only show users ads that potentially match their interests. For example, if a user is shown ads for products that he or she has been interested in on other websites, this is called "remarketing". For these purposes, when you visit our and other websites where the Google advertising network is active, Google executes code directly from Google and (re)marketing tags (invisible graphics or code, also known as "web beacons") are embedded in the website. The IP address of the user is also recorded, whereby this is shortened within member states of the European Union or in other states which are parties to the Agreement on the European Economic Area and only in exceptional cases is it transferred in full to a Google server in the USA and shortened there. Google may also combine the above-mentioned information with information from other sources. If the user subsequently visits other websites, advertisements tailored to his or her presumed interests can be displayed on the basis of his or her user profile.
User data is processed pseudonymously within the Google advertising network. This means that Google does not store and process, for example, the name or e-mail address of the user, but processes the relevant data in a cookie-based manner within pseudonymous user profiles. This means that from Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information collected by Google marketing services about users is transmitted to Google and stored on Google's servers in the USA.

16. Integration of third-party services and content
Within our online offer, we set the following priorities on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO), we use content or service offers from third parties in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content").
This always presupposes that the third-party providers of such content are aware of the IP address of the users, as without the IP address they would not be able to send the content to their browsers. The IP address is therefore required to display this content. We make every effort to use only such content whose respective providers use the IP address only to deliver the content. Third party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. Pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain technical information on the browser and operating system, referring web pages, visiting time and other details on the use of our online offer, as well as being linked to such information from other sources.
17. Use of the "registration function
You have the possibility to create a user account on our website.
During the registration process, the data entered in the input fields will be processed by us. This includes the following data as mandatory information:
- e-mail address
- Password
- Salutation
- First name
- Last name
Furthermore, you can add further data as voluntary information. The following data is potentially affected:
- Date of birth
- Mobile phone number
Mandatory and voluntary information is treated equally. The mandatory information is necessary to create a user account for you.
When sending the registration, the following data is also processed:
- Your IP address
- Date and time of sending
The purpose of processing personal data is to provide the user with his own user account. The purpose of processing the double-opt-in data is to prevent misuse of the registration and to log the acknowledgement of the privacy policy.
The legal basis for the processing of personal data described here is Art. 6 para. 1 lit. f.) DSGVO. There is a legitimate interest in providing you with a user account to make the use of our website more convenient for you. There is an interest in processing double-opt-in data in order to prevent misuse of our function. In addition, there is a legitimate interest in the logging of the registration in order to document that we have taken note of the privacy policy.
Right of objection
You have the right to object. You can deactivate or delete your user account independently at any time. You can also send or notify us of your objection at any time (e.g. by e-mail to privacy@nibsta.com).
The processed information will only be stored as long as it is necessary for the intended purpose or as long as it is legally required.

18. Using "WhatsApp
You can register via your mobile phone to receive information, offers etc. via WhatsApp. The mobile phone number collected during registration is processed by our technical service provider WhatsBroadcast GmbH, Schwanthalerstr. 32, 80336 Munich, Germany. In particular, the following additional data may be processed by Whatsbroadcast:
- Your user data stored on the Messenger platform;
- Your usage device;
- all messages sent to the service and which messages you have read and clicked on
- Registration time and IP address

Whatsbroadcast processes the mobile phone number exclusively to ensure the function of the WhatsApp service (e.g. sending and receiving messages)
The purpose of the processing of further data is to be able to create user categories for sending messages (e.g. if you have selected different categories that interest you).
The legal basis for the processing is Art. 6 para. 1 letter f) DSGVO. There is a legitimate interest in informing you of current offers. Furthermore, there is a legitimate interest in being able to show you individually suitable offers. Finally, there is a legitimate interest in documenting your registration, in particular to prevent misuse of our function.
The data will only be stored for as long as necessary to provide the function.
Right of objection
You have the right to object. You may send a message with the text "STOP" at any time via the chat at WhatsApp. You will not receive any further messages from us. You can also send a message via the chat with the text "DELETE ALL DATA". All of your stored data will then be deleted.
There is an order processing agreement with our service provider Whatsbroadcast. The data is therefore processed on our behalf. This data will not be passed on to third parties or processed independently by Whatsbroadcast.
The provision of personal data is neither required by law nor by contract and is not necessary for the conclusion of a contract. You are also not obliged to provide the personal data. Without the necessary information, however, we cannot provide you with information / offers via Whatsapp.
19. Social networks & external links
In addition to this website, we also maintain a presence in various social media, which you can reach by clicking on the corresponding buttons on our website. If you visit such a presence, personal data may be transmitted to the provider of the social network. It is possible that, in addition to the storage of the data you specifically entered in this social medium, further information may also be processed by the social network provider.
In addition, the social network provider may process the most important data of the computer system from which you visit it - for example your IP address, the type of processor used and browser version including plug-ins.
If you are logged in with your personal user account of the respective network while visiting such a website, this network can assign the visit to this account.

20. Contractual services
We process the data of our contractual partners and interested parties as well as other principals, customers, clients, clients or contractual partners (uniformly referred to as "contractual partners") in accordance with Art. 6 Par. 1 lit. b. DSGVO in order to provide them with our contractual or pre-contractual services.
